Transactional vs marketing email
This page explains common product and policy boundaries between transactional and marketing email using official documentation. It does not provide legal advice and does not guarantee compliance in any jurisdiction.
Purpose
| Message type | Typical purpose | Examples from official docs |
|---|---|---|
| Marketing | Promote a product, service, or content to encourage an action. | Brevo lists newsletters, sales campaigns, discounts, and event promotions. Twilio SendGrid’s glossary describes marketing as messages whose primary purpose advertises or promotes a commercial product or service (citing the U.S. CAN-SPAM framing). |
| Transactional | Inform a recipient about an action they took or a relationship message they need. | Brevo lists account confirmation, order/shipping confirmation, and password reset as transactional examples that should stay informational without marketing content. |

Consent
- Brevo documents that marketing emails require explicit consent (for example via checkbox or form) and that automation emails with promotional content inherit the same consent expectation.
- Brevo documents that purely informational transactional messages triggered by a user action are described as not requiring prior marketing consent.
- Omnisend documents subscribed contacts as eligible for campaigns, while non-subscribed contacts may receive transactional/behavior automations but not marketing campaigns; unsubscribed contacts are excluded from promotional sends.

Unsubscribe
- Brevo states unsubscribe links are mandatory for bulk/promotional campaigns and that Brevo will auto-add an unsubscribe footer if a campaign is missing one.
- Brevo states an unsubscribe link is not mandatory for transactional emails that remain essential/informational—but if a “transactional” automation is actually promotional (for example abandoned cart with offers), unsubscribe becomes mandatory.
- Twilio SendGrid documents unsubscribe/suppression tooling for marketing preference management and warns that all-or-nothing subscription tracking can block non-promotional mail such as password resets if misapplied.

Delivery and shared infrastructure
- Brevo recommends separating routing for transactional and marketing mail with different dedicated IPs and senders so marketing complaints do not damage transactional inbox placement.
- Omnisend’s billing docs note non-subscribers can still receive transactional automations that consume platform resources—another reason teams track message classes carefully even when campaigns are blocked.
- Shared IP/domain reputation means promotional spikes can affect the same infrastructure that carries password resets and order receipts unless you isolate streams.

Boundary checklist
- Write the primary purpose in one sentence before drafting.
- If the message advertises or promotes, treat it as marketing for consent and unsubscribe handling.
- Keep password resets, receipts, and shipping notices free of offers if you intend them to stay transactional.
- Review automation content—not only the channel name—before sending.
- Ask whether marketing and transactional streams share IPs, domains, or suppression logic.
Limits of this guide
Laws and mailbox-provider policies differ by region and change over time. Official product help centers summarize how those vendors classify messages; they are not a substitute for counsel. Email Pick Stack does not guarantee deliverability, inbox placement, or legal compliance.
